By accessing or using LocalCart ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform. We reserve the right to modify these Terms at any time, and your continued use of the Platform constitutes acceptance of any changes.

2. Description of Service

LocalCart is an online marketplace that connects local artisans and small businesses ("Sellers") with buyers looking for unique, handcrafted, and locally-made products. We provide the platform infrastructure but do not directly sell products or handle physical transactions.

3. User Accounts

To use certain features of LocalCart, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Not share your account with others

4. Seller Terms

If you register as a Seller on LocalCart, you additionally agree to:

• Provide accurate product descriptions, images, and pricing
• Only list products you are legally authorized to sell
• Fulfill orders promptly and communicate with buyers professionally
• Handle refunds and disputes fairly and in good faith
• Comply with all applicable local, state, and national laws
• Not sell prohibited items including illegal goods, dangerous materials, or counterfeit products

5. Buyer Terms

As a Buyer on LocalCart, you agree to:

• Provide accurate shipping and contact information
• Make payments as agreed with sellers
• Communicate respectfully with sellers
• Report any issues or disputes through proper channels

6. Transactions

LocalCart facilitates connections between Buyers and Sellers but is not a party to the transaction itself. All sales are directly between Buyers and Sellers. Payment arrangements, delivery, and dispute resolution are handled between the parties, typically via WhatsApp or other direct communication channels. LocalCart is not responsible for the quality, safety, or legality of items sold.

7. Prohibited Activities

You agree not to:

• Use the Platform for any unlawful purpose
• Post false, misleading, or fraudulent content
• Infringe on intellectual property rights of others
• Harass, abuse, or harm other users
• Attempt to circumvent platform security measures
• Use bots, scrapers, or automated tools without permission
• Manipulate reviews or ratings

8. Intellectual Property

The LocalCart name, logo, and all related graphics, interfaces, and content are the property of LocalCart and protected by intellectual property laws. Sellers retain ownership of their product content but grant LocalCart a license to display and promote their listings on the Platform.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOCALCART SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT ENDORSE OR GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF PRODUCTS LISTED BY SELLERS.

11. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. You may also delete your account at any time through your account settings.

12. Dispute Resolution

Any disputes arising from these Terms or your use of LocalCart shall be resolved through binding arbitration in accordance with applicable laws. You agree to first attempt to resolve any disputes informally by contacting us.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
